The case of Ramprasad, a daily wage laborer from Uttar Pradesh, is one such example. Accused of theft he never committed, he spent four years in jail awaiting trial simply because his family could not afford a lawyer. Cases like his are not anomalies; they are grim reminders of a broken system.

Home Secretary, Bihar (1979), the Court highlighted the plight of undertrials and held that speedy trials are a fundamental right under Article 21 of the Constitution. Similarly, in Sunil Batra v. Delhi Administration (1980), the Court condemned the inhuman treatment of prisoners, asserting that human dignity must be upheld even behind bars.

Despite these landmark judgments, systemic change remains slow. Subordinate courts often fail to implement the Supreme Court’s directions effectively. This is where law firms like The Lexà step in, not just as advocates but as catalysts for change.
